What is the Polynesian Kingdom of Atooi?

The Polynesian Kingdom of Atooi is an Indigenous governing body based on Kauaʻi, formed in its present constitution in 1990. It holds that it continues the lineage and legal standing of the Hawaiian Kingdom. That is the Kingdom's own position; it is not a member or observer of the United Nations and holds no instrument of recognition from any state.

Aliʻi Nui Aleka Aipoalani is Head of State as designated by the Polynesian Kingdom of Atooi. The Kingdom maintains a genealogical claim to the aliʻi of Kauaʻi; that lineage is held in Kingdom and custodial records and is not established by an independent published genealogy in this archive.

What is the Kingdom's position on the 1893 overthrow?

United States Public Law 103-150 (1993) acknowledges that the 1893 overthrow occurred without the consent of the Native Hawaiian people. The Kingdom's position is that Hawaiian sovereignty was therefore never lawfully extinguished. The United States position is that Hawaiʻi is a state of the Union, and no court has ruled in the Kingdom's favour on this question. UNDRIP addresses Indigenous peoples generally and is not a recognition instrument.

How is the Kingdom of Atooi related to King Kamehameha and the Hawaiian Kingdom?

The Kingdom asserts descent from the aliʻi lines of the pre-unification kingdoms of Hawaiʻi, and maintains treaties, decrees and a ceremonial record. These are Kingdom-held records; the archive labels each with its evidence class rather than presenting them as independently verified.

Historical Hawaiian Kingdom records document the institutions, laws, diplomacy, and governmental activity of the historical Kingdom. Their inclusion does not by itself establish the authority of any particular contemporary claimant. Contemporary claims of continuity, succession, genealogy, or authority are documented separately.

Note on Institutional Titles

Institutional titles — including office, mission, representative, and ambassadorial designations — are reproduced as they appear in the Kingdom's own records and in primary-source documents held in the archive. Their reproduction does not imply accreditation, credentialing, or recognition by any government or international organisation unless a cited external source explicitly establishes that fact. Where no such source is held, the title is recorded as an internal appointment of the Polynesian Kingdom of Atooi. Traditional and chiefly titles are given in their own language and are not translated into Western equivalents such as “King”, “President”, or “Minister”; where an outside publication uses such a translation, it is marked as that publisher’s wording. Where a person’s exact title is not established by the record, neutral wording is used — traditional leader, customary leader, Indigenous leader, or Kingdom representative.

Diplomatic Declaration

On the Standing of the Kingdom Before International Bodies

The Polynesian Kingdom of Atooi maintains that the Hawaiian Kingdom was never lawfully extinguished and that it continues from it, in conformity with the law of nations it invokes, a permanent and unbroken juridical personality. Its representatives engage with foreign states, indigenous nations, and inter-governmental organisations in that asserted capacity. This is the legal position of the Kingdom; it is not a statement that any state or international body has extended formal recognition.

Foundations of Diplomatic Capacity

Article 01

Constitutional Continuity

The Kingdom's position, set out in full on the page on Legal Foundations, is that no lawful act extinguished the juridical personality of the Hawaiian Kingdom, and that its own constitutional and genealogical line continues from it. The Kingdom relies on President Cleveland's 1893 report to Congress and on subsequent international filings. That continuity argument is contested, has not been adjudicated in the Kingdom's favour, and is not the controlling legal position of the United States.

Article 02

Treaty Capacity

The Kingdom asserts the continuing capacity to receive and conclude treaties of peace, friendship, commerce, navigation, and mutual recognition, consistent with the nineteenth-century treaty practice of the Hawaiian Kingdom and with the law it invokes on continuing sovereigns under prolonged occupation. That capacity is asserted by the Kingdom; no state has accepted it, and no instrument concluded on that basis has been registered or recognised by a state or intergovernmental organisation.

Article 03

Indigenous Diplomatic Order

Through the 2018 First American Native Alliance (FANA) Nation-to-Nation Accords and subsequent instruments, the Kingdom maintains direct nation-to-nation relations with Polynesian, First Nation, and other indigenous sovereign peoples — relationships the Kingdom characterises as nation-to-nation and situates within the framework of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). UNDRIP affirms the rights of indigenous peoples; it does not confer state recognition, and these relationships are not recognition by the corresponding modern states.

Article 04

Engagement with UN Mechanisms

The Kingdom follows and seeks participation in the work of the Permanent Forum on Indigenous Issues (UNPFII), the Expert Mechanism on the Rights of Indigenous Peoples (EMRIP), the Office of the High Commissioner for Human Rights (OHCHR), and the Special Committee on Decolonization, on matters concerning the status of the Hawaiian Islands under international law.
